What is Capacity?
Capacity is the ability to evaluate the risks and benefits of your choices and make informed decisions for yourself. We are all assumed to have capacity to make our own choices.
However, sometimes adults with known or suspected psychiatric or neurological conditions (dementia, neurocognitive disorder, traumatic brain injury, mental illness) lose some of their cognitive (thinking) abilities.
A Neuropsychologist can determine CAPACITY.
Only a judge can determine COMPETENCY (Legal Term).
