Confirming LACK of Capacity which is needed for Conservatorship (Estate and/or Person - including with or without Dementia Powers; determining if a locked facility is needed).
Confirming Capacity for assigning someone to have Durable Power of Attorney (DPOA) for Healthcare and Legal Decisions in the event of incapacity in the future (who do you want to make decisions on your behalf if you are not able to?)
Confirming LACK of Capacity so the DPOA can make medical and/or legal decisions on behalf of the patient (for financial planning and making medical decisions since the person lacks capacity).
To CONFIRM Capacity for completing Advanced Directives (end of life care wishes - hospice, comfort or palliative care, full code/allow natural death).
To CONFIRM Capacity prior to marriage or entering other contracts or making estate planning changes likely to be contested later.
When someone lacks capacity, documentation is often required to enable a Sucessor Trustee to assume responsibilities on behalf of the patient.
